Overview

In the Czech Republic, we encountered a widespread opinion in professional and lay circles that euthanasia is legal in the Netherlands. However, in reality, all situations mentioned in the title are a criminal offense under Dutch law. Exemption from prosecution is possible, but it applies only to medical doctors. If the doctors want to avoid criminal prosecution, they must follow the procedures prescribed by law. Performing termination of life or assisting in self-killing is subject to control, and if the procedures are not completely correct, the doctors may be prosecuted. We provide a short historical overview from the 19th century and from the first law in 1886. We describe all current Dutch laws: the 2002 law concerning persons from 12 years of age, the 2007 law concerning termination of pregnancy after 24 weeks of fetal life and newborns up to one year of age, and the 2024 addition to this law, which covers children from 1 year up to 12 years of age.
