Informed consent of seniors in long-term care

Overview
A written informed consent is a new possibility for most seniors in the Czech Republic. This article describes two strategies the physicians adopt towards seniors. The first and more often approach relates to underestimation of seniors’ decision-making capabilities. The second, less often one, regards, on the contrary, an over-estimation of their decision-making capabilities. In the first case, a frail long-term ill senior is not sufficiently informed and signing an informed consent is formal. In the second one, a senior lacks “good advice” and the doctor is often taken by surprised at activity of senior. Another serious and unresolved problem is incapacity to take, not de jure but de facto, legal decisions.
